(1) The Nepal Government or the officer designated by the Government of Nepal shall have the authority to initiate and dispose of the case under Section 11, and the Excise Officer shall have the authority to initiate and dispose of other cases under this Act.

(2) According to sub-section (1), the officer who initiates and terminates proceedings shall have the same powers as the District Court in accordance with the prevailing Nepalese law.
